Terms and Conditions - News Feed Service

General

This Terms and Conditions Agreement ("Agreement") contains the complete terms and conditions that apply to the use of the free and limited news headline syndication service ("Service") provided by Gayapolis, Inc. ("Gayapolis") by an individual or any entity ("User"). For the purposes of this agreement, "Content" refers to the headlines, links, and associated information delivered by Gayapolis and "Site" refers to any means for viewing the Content electronically, including, but not limited to World Wide Web websites, intranets, and extranets.

Use of Service

User acknowledges that the Content contains information and data that are protected by copyright, trademark, or other rights of Gayapolis.

User may not copy, publish, reproduce, distribute, display, or modify the in whole or in part, except as expressly permitted in this Agreement. User shall not be entitled to display any article linked to within the Content within a frame of any type on the Site. User shall be responsible for ensuring that the links appearing on their site, when clicked, will not open in a frame. At all times, User must designate Gayapolis as the source of news content.

The Content may not be used on any Site that Gayapolis determines to be unsuitable, including, but not limited to sites which feature sexually explicit material; promote or encourage discrimination based on sexual orientation, race, gender, religion, nationality or disability; promote violence; promote illegal activities; or violate intellectual property rights.

User must designate Gayapolis as the source of the Content on the Site. User agrees to permit Gayapolis to use User's name and Site name in marketing, reports, and any other advertising.

Responsibility

Gayapolis will make commercially reasonable efforts to maintain the accuracy, timliness, and availability of the service. Gayapolis makes no representation that the operation of the Service will be uninterrupted, error-free, or suitable for any specific purpose. Gayapolis will not be responsible for liable for any interruptions or errors in the Service. Gayapolis will not be liable for direct, indirect, consequential, or other damages, including, but not limited to loss of revenue or profits, resulting from or involving this Agreement or the use of the Service, even if Gayapolis has been advised of the possibility of such damages. Further, User will indemnify and hold Gayapolis harmless from all claims, damages, and expenses, including, without limitation, attorney's fees and litigation expenses, relating to the use of the Service on User's Site.

User is responsible for the development, operation, and maintenance of User's Site.

Some states do not allow exclusion of implied warranties or limitation of liability for incidental or consequntial damages, so the above limitations and exclusions may not apply to you. In such states, the liability of Gayapolis shall be limited to the greatest extent permitted by law.

Terms

The Service is provided free of charge. Gayapolis may modify any of the terms and conditions contained within this Agreement at any time at its sole discretion by posting a new agreement to Gayapolis' Site. Gayapolis may also choose to notify User via any electronic mail address provided. If any modification is unacceptable to the User, the only recourse is for the User to terminate this agreement. User's continued utilization of the Service following any change in these terms and conditions will constitute binding acceptance of the change

Gayapolis reserves the right to terminate this agreement at any time, at its sole discretion. This includes the right to suspend, restrict or terminate access to all or part of the Content at any time, for any reason, without prior notice.

User acknowledges that User has read this Agreement and agrees to all of its terms and conditions. User understands that Gayapolis will continue to solicit and market this service to other users, who may offer products that are similar to or compete with the User's products. User acknowledges that User has independently evaluated the suitability of this service for User's purposes and is not relying on any representation, guarantee, or statement other than those set forth in this Agreement.

This agreement shall be construed and enforced in accordance with the laws of the State of Indiana. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof.
