Another Colorado Marriage Equality Ruling - But Then a Stay
As expected, a Federal Judge struck down the state's marriage equality ban... and then stayed his ruling.

LGBTQ Nation reports:

A federal judge in Denver declared Colorado's gay marriage ban unconstitutional on Wednesday, but he issued a temporary stay of the ruling to give the state until next month to seek an appeal. Judge Raymond P. Moore's ruling was in response to a lawsuit filed July 1 by six gay couples who asked the court for an injunction ordering that the state's ban no longer be enforced. Colorado Republican Attorney General John Suthers and Democratic Gov. John Hickenlooper had requested a stay so the issue could eventually be decided by the U.S. Supreme Court - though both agreed the state ban should be declared unconstitutional.

Attorney General John Suthers has appealed the ruling.

Notice is hereby given that John Suthers, in his official capacity as the Attorney General of Colorado, in the above named case, hereby appeal to the United States Court of Appeals for the Tenth Circuit from the order granting a preliminary injunction entered in this action on the 23rd day of July, 2014. Respectfully submitted this 23rd day of July, 2014.

In the meantime, a state judge jas once again denied a request to block Boulder County Clerk Hillary Hall from giving marriage licenses to same sex couples.

On Top Magazine reports:

A Colorado judge on Wednesday denied a stay of his ruling allowing Boulder County to continue issuing marriage licenses to gay and lesbian couples. "In actuality, the State is asking this Court to reconsider its July 10, 2014 ruling and block Clerk Hall from issuing same sex marriage licenses," District Court Judge Andrew Harman said in his ruling. Harman said he was denying the request because the state "has offered no actual support in favor of reconsideration, more cases have found same sex marriage bans unconstitutional since the Court issued its ruling and the State [has] not met its burden to obtain a stay pending appeal under established Colorado law."

Hillary Hall: My very first experience was when I was in high school and we had a youth minister from a neighboring church whom everyone thought so highly of. He put on religious plays, and he would go around and tour on spring break. One year, he had a play that featured a gay character, and shortly after that he came out himself. And I just remember how these people who had loved and adored him turned on him. That hadnítóand still neverómakes sense to me.

Correction: we reported yesterday that Hall had stopped issuing licenses - but we cannot find any further substantiation of that report.

The Colorado fight is now proceeding on two separate tracks - one in state court and one in the Federal Courts. Which will get there first?
